Marijuana Dispensaries in New Mexico

Medical cannabis dispensaries are open in New Mexico, and Recreational sales are permitted as of April 1, 2022. Qualifying medical marijuana patients are legally allowed to purchase up to 8 ounces of cannabis over a 90-day period. Visiting patients from out-of-state can also shop at New Mexico dispensaries.

Is marijuana legal in New Mexico?

Yes! Both medical and recreational cannabis are legalized in New Mexico. Gov. Michelle Lujan Grisham signed  House Bill 2 on April 12, 2021 to legalize adult-use (“recreational”) cannabis in the state. The state established its medical marijuana program in 2007 under  HB 155, and previously decriminalized cannabis in 2019 under Senate Bill 323. Adult-use sales are permitted as of April 1, 2022.

How long is my medical cannabis ID valid?

All IDs are valid for one year. If you'd like to renew your card after the first year, you must submit a re-enrollment form for approval.

How many times can I be re-enrolled in the program?

Patients are allowed to re-enroll into the program each year with no maximum.

Where can I buy marijuana in New Mexico?

Adult-use sales are permitted as of April 1, 2022. Medical dispensaries are currently open for registered cardholders, and extend reciprocity to all out-of-state cardholders.

Where can I consume medical marijuana in New Mexico?

Cannabis consumption is allowable only on private property out of view from the public, and in smoking-permitted areas. The state specifically prohibits the following areas for consumption:

How should I store my medical marijuana?

Per  7.34.3 NMAC, “A qualified patient and primary caregiver shall ensure that all cannabis and cannabis-derived products that are purchased from a licensed non-profit producer remain in the package or container provided by the non-profit entity when not in use. If the package or container is damaged, the product label and any other identifying information from the package or container shall be kept and remain with the cannabis or cannabis-derived product upon transfer to another package or container."

Can I share my medical marijuana in New Mexico?

No, medical marijuana is intended for only the listed patient and cannot be shared with anyone else.

Can I buy medical cannabis for a friend in New Mexico?

Only the patient or a designated primary caregiver is allowed to purchase medical cannabis.

Will insurance cover my medical marijuana in New Mexico?

No, the patient needs to cover the cost of all medical cannabis products themselves.

Can I grow my own marijuana in New Mexico?

Yes. Residents of New Mexico 21+ may cultivate up to six (6) mature cannabis plants and six (6) immature plants. No more than 12 plants are allowed per household, regardless of the number of adults living there. For medical patients, Personal Production Licensed (PPL) patients and designated primary caregivers are allowed to cultivate up to 16 marijuana plants, with four mature and 12 seedlings on any property owned by the patient.

Can I shop at a medical dispensary in New Mexico if my medical card is from out-of-state?

Yes, New Mexico grants reciprocity to all medical marijuana cardholders with a valid card. In order to purchase, you must register with a dispensary in New Mexico. Further details about reciprocity can be found  here. 

Can I get fired for medical marijuana consumption?

Yes, while New Mexico state laws exempt patients from certain laws, employers are not obligated to accommodate an employee's medical marijuana consumption.
